1. Acceptance of Terms
By accessing or using Shoutcast Backoffice ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service following any updates to these Terms constitutes acceptance of those changes.
2. Service Description
Shoutcast Backoffice is an online radio broadcasting platform that enables users to:
- Upload and manage music libraries
- Create and organize playlists
- Schedule shows and automate broadcasting
- Stream audio content via Shoutcast servers
- Monitor listener statistics and stream health
- Manage station settings and user access
3. User Accounts
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account, including actions taken by any authorized users you invite to your station
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms or engaged in fraudulent or abusive behavior.
4. Coin Purchases and Payments
The Service operates on a coin-based billing system. You may purchase coins through available payment methods, including PromptPay and Internet Banking, processed by our payment partner Omise.
Important: No Refund Policy
All coin purchases are final and non-refundable. Once coins are purchased, they cannot be refunded, exchanged for cash, or transferred to another account under any circumstances. This includes, but is not limited to, unused coins, coins deducted for station subscriptions, bonus coins received through coupon promotions, and coins remaining in terminated or suspended accounts.
Coin packages are offered at various price points and may include promotional discounts. Promotional offers and coupon codes are subject to their own terms, including validity periods and usage limits.
5. Station Subscriptions
Each radio station requires a monthly subscription paid in coins. Key subscription terms:
- Subscriptions are billed monthly in coins based on your station's plan and configuration
- If auto-renewal is enabled, coins will be automatically deducted from your balance on the renewal date
- If your coin balance is insufficient at renewal, your station will be automatically suspended
- If auto-renewal is disabled, your station will be suspended when the current subscription period expires
- Suspended stations may have their streaming services and DNAS ports temporarily deprovisioned
6. Acceptable Use
You agree not to:
- Upload, broadcast, or distribute content that infringes on any third-party intellectual property rights, including copyrighted music without proper licensing
- Use the Service to broadcast illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable content
- Attempt to interfere with, compromise, or disrupt the Service's infrastructure, servers, or networks
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Share, sell, or otherwise transfer your account credentials to third parties without authorization
- Circumvent any technical measures or restrictions implemented by the Service, including storage limits and bitrate restrictions
You are solely responsible for ensuring that all content you upload and broadcast complies with applicable copyright laws and licensing requirements in your jurisdiction.
7. Intellectual Property
You retain all ownership rights to the content you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to store, process, and stream your content as necessary to provide the Service. This license terminates when you delete your content or close your account.
The Shoutcast Backoffice platform, including its design, features, and underlying technology, is the property of Shoutcast Backoffice and is protected by intellectual property laws.
8. Service Availability
We strive to provide reliable and uninterrupted service. However, we do not guarantee 100% uptime or availability. The Service may be subject to planned maintenance, unexpected outages, or other disruptions. We shall not be liable for any loss or damage resulting from service interruptions.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. In the event of a permanent discontinuation, we will make reasonable efforts to provide advance notice.
9. Limitation of Liability
To the fullest extent permitted by law, Shoutcast Backoffice and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability for any claims arising from the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.
10. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, when appropriate, through email notification or an in-app announcement. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
